§ 1 Preambel

1.1 ROTWILD is a manufacturer and provider of high-end mountain bikes and accessories. In line with our philosophy, we aim to establish a binding and fair business relationship with you as a consumer through the following General Terms and Conditions (“GTC”).

1.2 By placing an order and separately confirming the GTC, you agree to the application of these General Terms and Conditions to your order.

§ 2 Contractual Partner

2.1 The contractual partner for all goods you purchase through our shop is: ADP Engineering GmbH, Am Bauhof 5, 64807 Dieburg, Managing Director: Peter Schlitt, Commercial Register Darmstadt HRB - 90547, Phone: 06071 921 55-0, Email: info@rotwild.de.

§ 3 Requirements for Use and Registration

3.1 You can purchase bicycles and other products at www.rotwild.com. In both cases, you must acknowledge the validity of these GTC by clicking a check-box. You may save or print the GTC for your records. If you register, you must provide accurate and complete information. Please keep your password and access data confidential.

§ 4 Conclusion of Contract

4.1 The presentation of products and services in the ROTWILD online shop does not constitute a legally binding offer.

4.2 You may select items by clicking and place them in your shopping cart. As long as the products remain in the cart, you may change, expand, or remove your selection at any time. By clicking the “Place Order” button, you submit a binding purchase offer.

4.3 ROTWILD will send an order confirmation to the email address provided. This confirms receipt of your order. If the ordered items are available, you will receive an official order confirmation within three working days, which concludes the contract.You will receive the invoice by email after the contract has been concluded.

4.4 We deliver high-quality bicycles that require individual setup and instruction by a specialist dealer. Therefore, bicycles can only be ordered via “Click & Collect.” You must select a dealer during the checkout process who will prepare and adjust your desired bicycle. In case of warranty or guarantee claims, this dealer is your first point of contact.

§ 5 Prices and Payment Methods

5.1 All prices in the ROTWILD online shop are final prices including VAT, plus any applicable shipping costs.

5.2 Shipping costs depend on the total value of your order. Packaging and shipping costs are displayed in your cart. Before submitting your order, you will receive an overview of the total cost.

5.3 You can pay by prepayment (bank transfer) or via PayPal services. PayPal and credit card payments are processed by PayPal Plus (PayPal Europe S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg), subject to their terms and conditions.

5.4 Bicycles purchased via “Click & Collect” can also be financed through BNP Paribas S.A. For more information, visit www.rotwild.com/shop/click-collect-bikes. Please note that the financing agreement is concluded directly with BNP Paribas S.A.

§ 6 Delivery

6.1 We deliver non-bicycle products to addresses within the EU. Country restrictions for bicycles are listed on our website.

6.2 Delivery usually occurs within 10 working days (Monday to Friday, excluding public holidays). For prepayment, the delivery period begins the day after the payment order is submitted; for credit card orders, the period begins the day after the contract is concluded. Please note that the delivery times provided are not binding.

6.3 If you choose “Click & Collect” (mandatory for bicycles), we deliver the goods to the selected dealer after receipt of payment. The dealer will then contact you for collection.

§ 7 Retention of Title

7.1 All goods remain our property until full payment has been received.

§ 8 Right of Withdrawal

8.1 As a consumer, you have the following right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you (who is not the carrier) takes possession of the last item. To exercise your right of withdrawal, you must inform us, ADP Engineering GmbH, Am Bauhof 5, 64807 Dieburg, Phone: +49 6071 921 55-0, Email: info@rotwild.de, by means of a clear statement (e.g., letter sent by post or email). You may use the enclosed model withdrawal form, but it is not mandatory.

To meet the deadline, it is sufficient to send the notice before the withdrawal period expires.

Consequences of Withdrawal

a) Refund of the Purchase Price
If you withdraw from the contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the cheapest standard option offered by us), within fourteen days of receiving your withdrawal notice. Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed. No fees will be charged for the refund. We may withhold the refund until we have received the returned goods or proof that you have returned them, whichever is earlier.

b) Return of Goods
You must return the goods immediately and at the latest within fourteen days from the day you notify us of the withdrawal. In the case of “Click & Collect,” goods must be returned to the selected dealer. The deadline is met if you dispatch or return the goods before the fourteen-day period expires. You bear the direct cost of returning the goods. For bicycles, the cost is estimated at approximately EUR 40.00 per bike.
You are only liable for any diminished value of the goods if the loss in value results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. End of Withdrawal Policy

§ 9 Warranty

9.1 We are liable for defects in new goods in accordance with statutory provisions. This includes the right to inspect the defect. We may refuse performance if such inspection is not allowed. Therefore, you must make the defective product available to your ROTWILD dealer.

9.2 The statutory limitation periods apply. However, for used goods, the limitation period for claims for subsequent performance or withdrawal due to defects may be reduced to one year from handover if individually agreed. This does not apply to fraudulent concealment or warranty claims.

9.3 Details in order confirmations, brochures, or similar documents do not constitute guarantees under §§ 443, 444 BGB unless expressly designated as such. Minor deviations in color or signs of use/wear from intended use do not constitute defects.

9.4 Digital products (software, apps, etc.) are considered discontinued products. They are provided by third-party suppliers and are made available for at least the statutory warranty period. Beyond this period, we do not assume responsibility for functionality.

9.5 Some accessories may come with a manufacturer’s warranty. In such cases, you may claim directly against the manufacturer, typically through a ROTWILD dealer.

9.6 We also provide a voluntary manufacturer’s warranty under the conditions stated in our warranty terms. Warranty claims do not affect your statutory rights.

9.7 Warranty and guarantee periods begin on the date the goods are handed over.

9.8 Warranty conditions are available at www.rotwild.com/service/garantie and in the documents provided upon delivery.

§ 10 Liability

10.1 ROTWILD is liable for typically foreseeable damages caused by slightly negligent breaches of essential contractual obligations.

10.2 The above exclusions and limitations do not apply in cases of assumed guarantees, fraudulent concealment, injury to life, body or health, or liability under product liability laws.

10.3 We are also fully liable for gross negligence and intentional misconduct.

10.4 These rules also apply to our employees, agents, or subcontractors.

10.5 In cases of force majeure (e.g., war, riots, terrorism, natural disasters, epidemics, pandemics, embargoes, strikes, governmental orders, or other events beyond our control), we may extend delivery dates and deadlines according to the duration and impact of the event. You may not withdraw from the contract or claim damages during such extensions. If the force majeure lasts longer than three months, either party may withdraw from the contract.

§ 11 Copyright and Intellectual Property

11.1 All graphics, texts, and software on our website are protected by copyright and may not be published, made accessible to others, edited, used, or published in whole or in part without authorization.

11.2 You agree not to remove or obscure copyright notices or other references to such rights in the ROTWILD online shop.

§ 12 Data Protection

12.1 We process your data to fulfill our contractual obligations (Art. 6(1)(b) GDPR) and for direct marketing purposes (Art. 6(1)(f) GDPR). Data will be deleted once contractual obligations and statutory retention periods have expired or upon objection to direct marketing.

§ 13 Final Provisions

13.1 For questions or complaints, our customer service is available from 09:00–12:00 and 13:00–16:00 (Phone: +49 6071 921 55-0, Email: info@rotwild.de). ROTWILD prefers paperless communication for all correspondence.

13.2 If individual provisions are or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The parties shall replace the invalid provision with a valid one that comes closest to the intended purpose. The same applies to any contractual gaps.
